Abstract

<p><em>Valuation of land use rights is a crucial step in safeguarding the lawful rights and interests of individuals whose land is recovered. In Vietnam, the State conducts and determines the valuation of land use rights upon land recovery through competent agencies. The ongoing industrialization and modernization of the country require that this valuation process adhere to market principles. However, the 2013 Vietnam Land Law does not fully reflect these principles in its regulations on land use right valuation during land recovery. Therefore, it is necessary to improve the regulatory framework regarding the principles, participants, and procedures for land use right valuation to ensure a fair balance of interests between the State and affected landowners. By clarifying the concept of market principles in the context of land recovery, this study proposes solutions to enhance regulations on the principles, subjects, methods, and procedures for land use right valuation in Vietnam.</em></p>
